How do wrongful death and personal injury claims differ?
In a wrongful death, the victim has died as a result of the injuries sustained in an accident. Family members are then allowed to file a claim, thereby allowing them to collect damages to be used for such burdens as funeral expenses and loss of earning capacity. For a personal injury claim, the victim has not died, rather, has instead suffered serious and/or life-long debilitating injuries. Compensation can still be collected from a personal injury claim to be used for medical expenses or pain and suffering.
